Termos de Serviço
1. About us and these Terms
These Terms of Service (the "Terms") govern your purchase and use of products from esimdtc.com ("esimdtc", "we", "us", or "our"), an online store operated by Our Networking Canada Ltd., a company incorporated in Canada.
By placing an order on esimdtc.com, you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, please do not place an order.
If any part of these Terms conflicts with a mandatory consumer protection law that applies to you, that law prevails to the extent of the conflict, and the rest of these Terms remain in effect.
2. Our service
We sell prepaid, data-only travel eSIM packages for use at destinations shown on our website. Each package provides a stated amount of mobile data, for a stated validity period, on the local networks identified for that package before checkout.
Our eSIM packages do not include voice calls or SMS. Apps that use mobile data, such as messaging and internet calling apps, may be used with your data allowance, subject to the rules of those apps.
We do not sell physical SIM cards, and no physical product will be shipped to you. All products are delivered electronically by email, as described in Section 6.
Hotspot (tethering) works on every package whenever your device supports it; some devices need it switched on. Whether a package can be topped up is shown on each package. Top-up purchase through esimdtc is not yet available.
3. Eligibility and your device
You must be legally able to enter into a contract in your place of residence to place an order.
Before ordering, you must confirm that your exact device model supports eSIM and that your device is carrier-unlocked. Device model, sales region, and carrier restrictions differ, and a device that looks identical may not support eSIM in every version.
You are responsible for this compatibility check. Our device guidance is provided to help you check, but it does not replace checking your own device. Device incompatibility after this confirmation is not, by itself, a failure of fulfilment by us, subject to your statutory consumer rights and to our Refund Policy.
You are also responsible for providing a correct email address at checkout, and for keeping your installation details and QR code secure. Anyone with access to those details may be able to install or use your eSIM.
4. Ordering and contract formation
Product pages show the destination, data allowance, validity period, available networks, and price before checkout. Please review these details carefully before you pay, because they form part of your contract with us.
Your order is an offer to buy the selected package. A contract is formed when we confirm your order and successfully fulfil it, as described in Sections 5 and 6.
We may decline or cancel an order before fulfilment if the package is unavailable, if pricing or product information was clearly in error, if payment authorisation fails, or if we reasonably suspect fraud or abuse. If we cancel for these reasons and payment was captured, we will refund it in full to your original payment method.
5. Prices and payment
All prices on esimdtc.com are shown in United States dollars (USD), unless a different currency is expressly shown at checkout. The amount shown at checkout is the amount you will be charged; there are no additional charges from us after checkout for the package you selected.
Your bank or card issuer may apply currency conversion or foreign transaction fees if your card is not denominated in USD. Those fees are set by your issuer, not by us.
Payment is processed through our payment processor's hosted checkout. You enter your payment details on our payment processor's pages; we do not receive or store your full card number.
When you place an order, your payment method is authorised. Payment is captured only after your order has been successfully fulfilled. If fulfilment fails, no payment is captured; any authorisation hold is released by your issuer in accordance with its own timelines.
By paying, you confirm that you are authorised to use the payment method provided.
6. Delivery, installation, and activation
After your order is confirmed, we send your installation details, including your QR code and installation instructions, by email to the email address provided at checkout. Delivery is normally completed within 15 minutes of order confirmation. In uncommon cases, delivery may take longer; if you have not received your installation email within 2 hours, please check your spam or junk folder and then contact us with your order reference.
Delivery is complete when the installation email is sent to the email address you provided. We are not responsible for non-delivery caused by an incorrect email address, a full mailbox, or your email provider's filtering.
We recommend installing your eSIM over a reliable Wi-Fi connection before you travel, following the instructions provided, and keeping the travel eSIM turned off until you are ready to use it at your destination.
The validity period of a package starts on its first connection to a supported network at your destination, unless the package description states a different activation rule.
An unused package that has not connected to a network expires 180 days after purchase and can no longer be installed or used. Expired packages are not refundable except where required by law.
7. Acceptable use
You agree to use your eSIM package only for lawful, personal purposes and in accordance with the laws and regulations of the country in which you use it.
You must not resell or redistribute packages or installation credentials, use the service for fraud or spam, attempt to circumvent package limits, or use the service in a way that harms a network operator or other users.
Packages are subject to any fair-use conditions stated in the package description. Network operators may manage traffic, and speeds may vary.
We or the relevant network operator may suspend a package if we reasonably believe it is being used in breach of this Section or of applicable law.
8. Coverage and service availability
Coverage maps, network names, and technology (for example, 4G or 5G) shown for a package reflect the information we receive from our supplier and local network operators. Actual coverage and speed depend on the local network, your location, your device, and local conditions, and cannot be guaranteed at every location or at all times.
Temporary outages, maintenance, and roaming partner changes may affect service. If an installed eSIM cannot connect and the service cannot be provided, that is our fulfilment responsibility, as set out in our Refund Policy.
9. Support
Customer support is available by email at sales@esimdtc.com. Please include your order reference in every message so we can find your order quickly.
We aim to respond to support messages within 24 hours on business days. Troubleshooting may require information about your device model, settings, and location; your cooperation with reasonable troubleshooting steps helps us resolve issues and is considered if a refund is requested.
Please never send payment card details or your eSIM QR code or installation credentials to support.
10. Cancellations and refunds
Cancellation and refunds are governed by our separate Refund Policy, which forms part of these Terms. In summary: orders may be cancelled before fulfilment; unused, uninstalled packages are reviewed for a refund subject to package restrictions; and an installed eSIM that cannot connect, where service cannot be provided, is refundable as a fulfilment failure. Your statutory consumer rights are unaffected.
11. Liability
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.
Subject to the paragraph above, our total liability arising from an order is limited to the amount you paid for the package giving rise to the claim. We are not liable for indirect or consequential losses, such as missed bookings or alternative roaming charges, except where such limitation is prohibited by applicable law.
The service is provided using networks and suppliers outside our direct control. Except as expressly stated in these Terms and our Refund Policy, we make no warranties beyond those required by applicable law.
12. Changes to these Terms and to our service
We may update these Terms from time to time. The version in effect when you place an order governs that order. We will change the "Last updated" date on this page when we make changes.
We may add, change, or withdraw packages and destinations at any time. Changes do not affect packages you have already purchased and had fulfilled.
13. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be subject to the jurisdiction of the courts of Ontario, Canada, unless a mandatory consumer protection law in your place of residence gives you the right to bring proceedings elsewhere.
